1. Acceptance of terms

By downloading, installing, or using the **Rivo** app (bundle `com.getrivo`), you agree to these Terms of Service and our [Privacy Policy](./privacy-policy-en.md). If you do not agree, do not use the app.

2. Eligibility

You represent that:

You are at least **18 years old** or have parental/guardian consent.
You have legal capacity to enter into contracts under applicable law.
You provide truthful information during signup.

If Rivo is used by a minor without consent, contact us immediately for account deletion.

3. License grant

We grant you a **personal, non-transferable, non-exclusive, revocable** license to use Rivo on iOS devices owned or controlled by you, exclusively for personal non-commercial use.

**You may NOT:**

Copy, modify, distribute, sell, or rent any part of the app.
Reverse-engineer, decompile, or attempt to obtain the source code.
Share your account with third parties.
Use Rivo for illegal purposes or to violate third-party rights.

4. Payment and subscriptions

4.1 Premium plans (3 tiers)

Rivo runs on a **hard paywall, no trial** model with three plans:

**International pricing:** set via App Store Connect (Custom Pricing per country). Other countries follow Apple's automatic PPP adjustment.

**Coverage:** all plans unlock full access to all current and future features while the plan is active.

4.2 Lifetime early-bird

During the first **60 days after launch**, the Lifetime plan is available at a discount:

**Brazil:** R$ 399.90 (20% OFF)
**US/UK/CA/AU:** $159.99
**Eurozone:** €149.99

**Founding Cohort:** first 200 spots (Cohort I + Cohort II of 100 each). After Cohort II or after 60 days, the early-bird discount ends permanently.

4.3 Processing

**iOS App Store:** via In-App Purchase (StoreKit 2). Charged by Apple.
**Web (V1.1):** via Hubla (Brazil) — subject to Hubla's terms.

4.4 Auto-renewal (Monthly and Annual plans)

Monthly and Annual subscriptions **auto-renew** at the end of each period unless cancelled in advance.
You can cancel any time in **Apple ID Settings → Subscriptions**. Access continues until the end of the paid period.
The Lifetime plan **does not renew** — it is a one-time purchase.

4.5 Right of withdrawal (Brazilian Consumer Code Art. 49)

For distance purchases in Brazil, you have the right to withdraw within **7 calendar days** of purchase, with full refund. Request via legal@getrivoapp.com.

After 7 days, payment is **non-refundable**, except where law expressly requires refund (severe service defect, failure of provision, etc.).

4.6 Apple refund policy

Refunds via App Store follow Apple's policy and are processed directly by Apple. Rivo does not control or reverse those decisions. Request at https://reportaproblem.apple.com/.

4.7 Price changes

Price changes for subscriptions (Monthly/Annual) will be communicated in advance per Apple and Brazilian Consumer Code requirements, and require active consent renewal. Already-completed **Lifetime** purchases retain forever-access without additional charge.

5. Your responsibilities

By using Rivo, you commit to:

Keep your access credentials safe (Apple ID / Google).
Not use the app in ways that overload our infrastructure.
Report bugs or unexpected behavior via legal@getrivoapp.com.
Follow health guidance from qualified professionals — Rivo does not replace medical advice (see Section 6).

6. Medical disclaimer — IMPORTANT

**Rivo is NOT a medical device and does not provide medical advice, diagnosis, or treatment.** Breathing, meditation, focus, and movement exercises are **behavioral support** for wellbeing, not clinical treatment.

**You should:**

Consult a **qualified healthcare professional** (physician, psychologist, physical therapist) before starting any program that may affect your physical or mental health.
**Stop immediately** any exercise causing discomfort, dizziness, shortness of breath, chest pain, or other adverse symptoms.
Not substitute medical treatment, prescribed medication, or psychological therapy with app use.

**Crisis resources:**

**EU:** 116 123 (Samaritans / international)

**Rivo, its operators, and licensors are not liable** for consequences of misuse without proper medical guidance.

7. Intellectual property

All app content (texts, audio, design, code, logos) is property of Bruno Osorio, protected by Brazilian Copyright Law (Lei nº 9.610/98) and applicable international treaties.
Your **account and user content** (journaling, gratitudes) remain your property. You grant Rivo a limited license to store and process this content as necessary to deliver the service.
Rivo trademarks, logos, and visual identity may not be used without written authorization.

8. Service availability and modifications

We strive to maintain 24/7 availability but **do not guarantee** uninterrupted service. Scheduled maintenance will be communicated when possible.
We **reserve the right** to modify, suspend, or discontinue features at any time. Material changes will be communicated.
In case of total service discontinuation, we will offer **data export** with at least 90 days notice.

9. Limitation of liability

To the maximum extent permitted by law:

Rivo is provided **"as is"** without express or implied warranties beyond those required by law.
We are not liable for indirect, incidental, consequential damages, lost profits, or data loss arising from app use.
Our total liability, in any case, is limited to the amount you paid in the last **12 months** for Rivo access.

These limitations **do not apply** to cases of intentional misconduct, fraud, or gross negligence by Rivo, per applicable law.

10. Indemnification

You agree to indemnify Rivo, its operators, and partners against third-party claims arising from:

Your misuse of the app.
Violation of these Terms.
Violation of third-party rights through your conduct.

11. Suspension and termination

You may terminate your account at any time via **Profile → Delete account** (30-day soft delete + hard delete).
We may suspend or terminate your account for:
Violation of these Terms.
Payment fraud.
Abusive behavior (infrastructure attacks, bug exploitation).
In case of termination by us, we will make reasonable effort to notify you and allow data export, except where prohibited by law (e.g., criminal investigation).

12. Modifications to these Terms

We may update these Terms periodically. Material changes will be communicated via:

Registered email.
In-app notification.
Update of "Last updated" date at the top of this document.

Continued use after notification implies acceptance. If you disagree, you may close your account within 30 days of notification.

13. Governing law and jurisdiction

These Terms are governed by the **laws of the Federative Republic of Brazil**. The forum of São Paulo/SP, Brazil, is elected for dispute resolution, except for consumer rights to elect their domicile forum (Brazilian Consumer Code Art. 101).

For consumer users outside Brazil, mandatory consumer protection rights of your country of residence apply.

14. General provisions

**Severability:** if any clause is deemed invalid, the others remain in force.
**No waiver:** failure to exercise a right does not constitute waiver.
**Entire agreement:** these Terms + Privacy Policy constitute the entire agreement between you and Rivo, superseding prior understandings.
